Mediação Online, a legal dispute mediation service for Brazilian businesses and consumers, recently received R$500k in investment from 500 Startups, having previously been accelerated at Wayra Brasil. In this interview with founder & CEO Melissa Felipe Gava, we learn about Brazil’s “stratospheric” number of litigation proceedings, and how Mediação Online is working to lower the cost of mediation services.

LAVCA: How and why did you start Mediação Online (Mediation Online)?

Melissa Felipe Gava: I studied law in Europe (at La Sapienza, Rome and La Sorbonne-Paris 1, Paris) and came in close contact with the discipline of ADR (alternative dispute resolution), that is, alternative methods of conflict resolution. Once I was done with my undergraduate course, I took an ODR course (online dispute resolution) in the US. I began to act as a mediator for conflicts in Europe and when I returned to Brazil I wanted to continue to act as an extrajudicial mediator, but the options were very scarce. I acted as a voluntary judicial mediator in São Paulo and began studying the market.

I realized that the market lacked mediation services. Chambers of Mediation and Arbitration existed but were designated to a very select segment due to their extremely high fees. I came up with the idea of ​​creating a mediation service in order to popularize access and lower the cost of the procedure, and with the best possible experience for the user. 

LAVCA: Who are your investors?

Melissa Felipe Gava: Our first investors were friends and family. In January 2017, we entered the Wayra accelerator program in Brazil, and in July we joined the 500 Startups program in San Francisco, Silicon Valley.

LAVCA: What is the opportunity you see in the Brazilian mediation market?

Melissa Felipe Gava: Brazil is becoming more aware of mediation as a viable option, and this is a very positive marker. The 1988 Constitution had already planted the seeds, and 2016 was a year of great achievement: The Mediation Law (13.140 / 2015) was sanctioned to discipline extrajudicial, judicial, public and online mediation, and there was also the New Code of Civil Procedure, which adopted mediation in its text.

Brazil urgently needs measures to combat the stratospheric numbers of lawsuits and the culture of litigation. Mediation, as well as other friendly compositing methods, are a great alternative. The online solution is what ensures the scalability, and therefore the operational ability to handle the demands. This combination goes well with the current trend of companies, to offer win-win solutions and great customer experience.

Mediação Online é um serviço especializado na busca de soluções de conflitos jurídicos extrajudiciais. Foi acelerado na Wayra Brasil, e recebeu recentemente um investimento de R$500k de 500 Startups. Nesta entrevista com a fundadora e CEO Melissa Felipe Gava, aprendemos sobre “os números estratosféricos de processos no judiciários” e sua idéia de criar um serviço de mediação “com o intuito de popularizar o acesso e o custo do procedimento.”

LAVCA: Como/por que criou Mediação Online?

Melissa Felipe Gava: Estudei direito na Europa (na La Sapienza, Roma e La Sorbonne-Paris 1, Paris) e logo na graduação entrei em contato com a disciplina de ADR (alternative dispute resolution), ou seja, métodos alternativos de solução de conflito. Quando terminei a graduação fiz um curso de ODR (online dispute resolution) nos EUA. Comecei a atuar como mediadora de conflitos na Europa, e quando regressei ao Brasil, queria continuar a atuar como mediadora extrajudicial, porém as opções eram muito escassas. Atuei como mediadora judicial voluntária em São Paulo e comecei a estudar o mercado.

Percebi que o mercado era carente de serviço de mediação. Câmaras de Mediação e Arbitragem existiam, porém destinadas a um público muito seleto, pois os valores são extremamente altos. Dai veio a idéia de criar um serviço de mediação com o intuito de popularizar o acesso e o custo do procedimento, e que fosse a melhor experiência possível para o usuário, ai começou a aventura!

LAVCA: Quem são seus investidores?

Melissa Felipe Gava: Primeiro aconteceu uma rodada de investimento familiar. Em janeiro de 2017 entramos para o programa da aceleradora Wayra, no Brasil, e em julho, para o programa da 500 Startups em São Francisco, no Silicon Valley.

LAVCA: Qual é a oportunidade que você enxerga no mercado de medicação brasileiro?

Melissa Felipe Gava: O Brasil se despertou para a mediação, e isso é um sinal muito positivo. A Constituição de 1988 já havia plantado as sementes, e em 2016, foi um ano de grandes conquistas: foi sancionada a Lei da Mediação (13.140/2015) que disciplina a mediação extrajudicial, judicial, pública e online e houve também a mudança do Novo Código de Processo Civil, que adotou a mediação em  seu texto.

O Brasil precisa urgentemente de mediadas para combater os números estratosféricos de processos no judiciários e a cultura do litígio. A mediação, assim como os outros métodos de composição amigável, são uma grande alternativa. A solução online é o que garante a escalabilidade, e portanto a capacidade operacional de tratar as demandas. Essa combinação vai muito de encontro com a tendência atual das empresas, de oferecer soluções win-win e customer experience para seus clientes.
